Términos de Servicio

Estos términos son el acuerdo entre tú y Gombiz Labs LLC (la empresa que opera Trovaki) cada vez que usás el servicio. Al crear una cuenta o usar la aplicación, los aceptas. Están escritos para leerse, no para esconder nada: si algo no queda claro, escríbenos.

1. Qué es Trovaki

Trovaki es una herramienta de gestión de pedidos, clientes y cobros para negocios: registras lo que te encargan, a quién, para cuándo y por cuánto, y la aplicación te ayuda a organizarlo, cotizarlo, documentarlo y cobrarlo.

2. Tu cuenta

Tienes que ser mayor de 18 años para crear una cuenta.
Los datos que nos das al registrarte deben ser veraces y mantenerse al día.
Tus credenciales son tuyas: no las compartas. Lo que se haga desde tu cuenta es tu responsabilidad. Si sospechas un acceso no autorizado, avísanos.
Dentro de tu negocio puedes invitar a otras personas con distintos roles. Tú decides quién entra y qué puede hacer; sus acciones dentro de tu negocio corren por cuenta del negocio.

3. Estado del servicio: beta

Trovaki está en fase beta. Eso significa que el servicio está en prueba y desarrollo activo: pueden aparecer errores, las funciones pueden cambiar o retirarse, y puede haber interrupciones. Hacemos copias de seguridad y trabajamos con cuidado, pero durante la beta no garantizamos disponibilidad ni continuidad del servicio.

Te recomendamos exportar o respaldar tu información con regularidad. Si te invitamos a la beta, es posible que además te pidamos aceptar un aviso específico dentro de la aplicación; ese aviso complementa estos términos, no los reemplaza.

4. Tus datos y los de tus clientes

Tus datos son tuyos y los de tus clientes son de ellos. Nosotros los tratamos para prestarte el servicio, como explica en detalle la Política de Privacidad, que forma parte de estos términos.

Sobre los datos de tus clientes finales, el responsable eres tú. Tú decides qué información de tus clientes cargas en Trovaki, y es tu responsabilidad tener derecho a usarla, informarles cuando corresponda y responder si te piden acceder a ella o borrarla. Nosotros la procesamos por tu cuenta y siguiendo tus instrucciones.

5. La función "Desde chat"

Trovaki puede analizar el texto de una conversación que tú le pegues o subas, y proponerte un pedido armado a partir de lo que encuentre. Para esta función aplican tres reglas:

Solo importa conversaciones que tienes derecho a usar. Eres tú quien decide qué texto entra; asegúrate de poder usarlo.
El resultado es una propuesta, no un hecho. La aplicación te muestra qué encontró, con qué confianza y en qué mensaje se apoya, y nada se crea sin tu confirmación. Revisa antes de confirmar: la extracción puede equivocarse y no garantizamos su exactitud.
El texto no se almacena. La conversación se procesa para generar la propuesta y no se guarda en nuestros servidores. Quién la procesa y bajo qué condiciones está en la lista de subprocesadores.

6. Pagos y suscripciones

Durante la beta, el acceso que te demos es de cortesía y podemos definir sus condiciones al invitarte. Cuando el servicio salga de beta, los planes y precios estarán publicados, y las suscripciones se procesan a través de Stripe. Los precios pueden cambiar; si cambian, te avisaremos antes de que afecte tu próximo cobro.

Los cobros que tu negocio les hace a tus clientes (por ejemplo, con un enlace de pago) son una transacción entre tú y ellos: Trovaki es la herramienta que la facilita, no una parte de esa venta. Los reembolsos a tus clientes los decides tú.

7. Uso aceptable

Al usar Trovaki te comprometes a no:

Usar el servicio para actividades ilegales o para dañar a terceros.
Intentar acceder a datos de otros negocios o cuentas, ni sondear o vulnerar la seguridad del servicio.
Sobrecargar o abusar del servicio (por ejemplo, automatizar peticiones masivas).
Revender, sublicenciar o dar acceso al servicio a terceros fuera de tu negocio.
Cargar contenido que no tienes derecho a usar.

8. Propiedad

El servicio, su código, su diseño y su marca son de Gombiz Labs LLC. Estos términos te dan derecho a usarlo, no propiedad sobre él.

Tu información es tuya. Los datos de tu negocio, tus clientes y tus pedidos te pertenecen; nos das permiso para tratarlos únicamente para prestarte el servicio. Puedes llevártelos: escríbenos y te los entregamos en un formato legible por máquina.

9. Sin garantías y límite de responsabilidad

El servicio se presta "tal cual" y según disponibilidad, sin garantías de ningún tipo, expresas o implícitas, incluyendo idoneidad para un propósito particular. Esto pesa especialmente durante la beta (sección 3).

En la máxima medida que permita la ley, la responsabilidad total de Gombiz Labs LLC por cualquier reclamo relacionado con el servicio se limita al monto que nos hayas pagado en los 12 meses anteriores al hecho que origine el reclamo. Durante una beta de cortesía ese monto puede ser cero, y lo decimos sin esconderlo. No respondemos por daños indirectos, lucro cesante ni pérdida de datos que un respaldo razonable habría evitado.

Nada en estos términos limita responsabilidades que la ley no permite limitar.

10. Terminación

Puedes cerrar tu cuenta cuando quieras; la eliminación de tus datos sigue los plazos de la Política de Privacidad.

Nosotros podemos suspender o cerrar una cuenta que viole estos términos. Salvo en casos de abuso grave o riesgo para el servicio o para terceros, te avisaremos y te daremos oportunidad de corregir antes de cerrar.

11. Ley aplicable y cambios

Estos términos se rigen por las leyes del Estado de Florida, Estados Unidos. Cualquier disputa se resolverá en los tribunales del condado de Miami-Dade, Florida.

Si cambiamos algo material de estos términos, actualizaremos la fecha del encabezado y, cuando el cambio sea significativo, te avisaremos dentro de la aplicación o por correo antes de que entre en vigor. Seguir usando el servicio después del aviso significa que aceptas la versión nueva.

Si alguna cláusula resulta inválida, el resto sigue en pie.

Terms of Service

These terms are the agreement between you and Gombiz Labs LLC (the company that operates Trovaki) whenever you use the service. By creating an account or using the app, you accept them. They are written to be read, not to hide anything: if something is unclear, write to us.

1. What Trovaki is

Trovaki is an order, client, and payment management tool for businesses: you record what people order from you, who they are, when it is due and for how much, and the app helps you organize, quote, document, and collect it.

2. Your account

You must be at least 18 years old to create an account.
The information you give us when registering must be accurate and kept up to date.
Your credentials are yours: do not share them. What happens from your account is your responsibility. If you suspect unauthorized access, let us know.
Within your business you can invite other people with different roles. You decide who joins and what they can do; their actions within your business are the business's responsibility.

3. Service status: beta

Trovaki is in beta. That means the service is under active testing and development: bugs may appear, features may change or be removed, and there may be interruptions. We keep backups and work carefully, but during the beta we do not guarantee availability or continuity of the service.

We recommend exporting or backing up your information regularly. If we invite you to the beta, we may also ask you to accept a specific notice inside the app; that notice complements these terms, it does not replace them.

4. Your data and your customers' data

Your data is yours, and your customers' data is theirs. We process it to provide the service to you, as explained in detail in the Privacy Policy, which forms part of these terms.

For your end customers' data, you are the controller. You decide what customer information you enter into Trovaki, and it is your responsibility to have the right to use it, to inform your customers where required, and to respond if they ask to access or delete it. We process it on your behalf and following your instructions.

5. The "From chat" feature

Trovaki can analyze the text of a conversation you paste or upload, and propose an order built from what it finds. Three rules apply to this feature:

Only import conversations you have the right to use. You decide what text goes in; make sure you may use it.
The result is a proposal, not a fact. The app shows you what it found, with what confidence and based on which message, and nothing is created without your confirmation. Review before confirming: the extraction can be wrong and we do not guarantee its accuracy.
The text is not stored. The conversation is processed to generate the proposal and is not kept on our servers. Who processes it and under what conditions is in the list of subprocessors.

6. Payments and subscriptions

During the beta, any access we grant you is complimentary and we may define its conditions when inviting you. Once the service leaves beta, plans and prices will be published, and subscriptions are processed through Stripe. Prices may change; if they do, we will let you know before it affects your next charge.

The charges your business makes to your customers (for example, through a payment link) are a transaction between you and them: Trovaki is the tool that facilitates it, not a party to that sale. Refunds to your customers are your decision.

7. Acceptable use

By using Trovaki you agree not to:

Use the service for illegal activities or to harm others.
Attempt to access other businesses' or accounts' data, or probe or breach the service's security.
Overload or abuse the service (for example, automating bulk requests).
Resell, sublicense, or give access to the service to third parties outside your business.
Upload content you do not have the right to use.

8. Ownership

The service, its code, its design, and its brand belong to Gombiz Labs LLC. These terms give you the right to use it, not ownership of it.

Your information is yours. Your business's, your customers', and your orders' data belong to you; you grant us permission to process them solely to provide the service. You can take them with you: write to us and we will deliver them in a machine-readable format.

9. No warranties and limitation of liability

The service is provided "as is" and as available, without warranties of any kind, express or implied, including fitness for a particular purpose. This weighs especially during the beta (section 3).

To the maximum extent permitted by law, Gombiz Labs LLC's total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. During a complimentary beta that amount may be zero, and we say so openly. We are not liable for indirect damages, lost profits, or data loss that a reasonable backup would have prevented.

Nothing in these terms limits liabilities that the law does not allow to be limited.

10. Termination

You can close your account whenever you want; deletion of your data follows the timelines in the Privacy Policy.

We may suspend or close an account that violates these terms. Except in cases of serious abuse or risk to the service or to third parties, we will notify you and give you a chance to correct before closing.

11. Governing law and changes

These terms are governed by the laws of the State of Florida, United States. Any dispute will be resolved in the courts of Miami-Dade County, Florida.

If we change anything material in these terms, we will update the date in the header and, where the change is significant, notify you inside the app or by email before it takes effect. Continuing to use the service after the notice means you accept the new version.

If any clause is found invalid, the rest remains in force.
